Edgar Carranza Secures Defense Verdict for Chiropractic Physician


In May 2010, shareholder Edgar Carranza successfully secured a defense verdict in a personal injury lawsuit filed against a Las Vegas chiropractor by one of his former patients.   In the lawsuit, the plaintiff attempted to present both intentional torts and malpractice claims, arguing that the chiropractic physician failed to provide appropriate treatment for her complaints and, instead, sexually battered her.  She also questioned his method of examination, particularly the x-ray exams.  Hearing testimony from both parties and their experts, the decision held as follows on the crucial issues of the case:

  • That the physicians x-rays of the patient were not below the standard of care.
  • That based upon the testimony of the defense expert, that mode of straddling the treatment table while performing acupressure therapy is an acceptable and common practice.
  • That the physician did not directly massage Plaintiff’s breasts and, furthermore, that the massage of the pectoral muscles was not below the standard of care.  
  • That the physician did not massage plaintiff’s inner thigh or expose her private area, but rather provided the appropriate leg stretches as indicated by plaintiff’s complaints.
  • That the physician obtained informed consent prior to performing therapy.
  • That the physician did not sexually assault and batter plaintiff.

Mr. Carranza defends chiropractic physicians, and other professionals, against claims of malpractice and before their respective disciplinary boards.
